Welcome to GENAIVA, an AI-driven telephony service designed for restaurants. By accessing or using GENAIVA, you agree to comply with these Terms of Use. If you do not agree, please refrain from using our services.

1. User Eligibility

GENAIVA is available to individuals and businesses legally permitted to make purchases online. Users must meet the minimum age requirements set by OpenAI, Deepgram, and Twilio (currently 18 years old, unless their policies state otherwise).

2. Scope of Service

GENAIVA provides AI-driven telephony services for restaurants, including:

  • AI-powered order-taking and reservation management
  • POS system integration (e.g., Square, Toast)
  • Analytics and customer insights
  • Multilingual and real-time speech processing

GENAIVA may update or modify services at any time to enhance functionality or improve security.

3. Payment & Subscription

GENAIVA offers the following payment models:

  • Monthly Subscription – Recurring payments for continued access to services.
  • Pay-As-You-Go – Flexible, usage-based billing.
  • Custom Pricing – Enterprise solutions tailored to business needs.

Payments must be made on time. A 5-day grace period is allowed for overdue payments. If payment is not received within this period, the account will be suspended and then terminated.

Refunds are not provided unless required by law.

4. Acceptable Use Policy

To maintain service integrity, users must adhere to the following:

  • No fraudulent credit card information.
  • No fake reservations, orders, or other misleading interactions.
  • No misuse of AI for spam, harassment, or unethical purposes.
  • No attempts to reverse-engineer, modify, or exploit the AI system.
  • No unlawful or prohibited activities using GENAIVA’s services.

Violations may result in immediate account termination.

5. Data Ownership & Retention

  • GENAIVA retains full ownership of all anonymized call logs and AI-generated data, however, GENAIVA ensures that none of this data is identifying of its users. 
  • Users may request data deletion, but GENAIVA will remove identifying information and may use anonymized data for AI training and marketing purposes.
  • Users may request data deletion. Upon request, GENAIVA will remove identifying information and may continue to use anonymized data for AI training and marketing purposes.
  • GENAIVA will never sell, retain, or use personally identifying information of callers who interact with our AI agents.
  • GENAIVA only uses identifying information for the duration necessary to fulfill the service requested and ensures strict compliance with privacy standards.
  • SMS communications: GENAIVA may send SMS messages to callers strictly upon request to facilitate secure payments or confirm orders. Verbal confirmation of receiving payment/order details via SMS is considered Verbal Consent to receive SMS communication. 

6. Service Modifications & Termination

  • GENAIVA reserves the right to update features, pricing, or terms with prior notice.
  • Accounts will be terminated for non-payment after the 5-day grace period.
  • Misuse of the platform will result in immediate suspension or termination with notification via the user’s chosen contact method.

7. AI Disclaimer & Liability Waiver

  • GENAIVA utilizes AI to process customer interactions, but errors may occur (e.g., misheard orders, incorrect reservations).
  • Users acknowledge and accept the possibility of AI inaccuracies.
  • GENAIVA is not liable for any financial loss, reputation damage, or other consequences resulting from AI errors.

8. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the United States and the State of Maryland.
  • Any disputes shall be resolved through arbitration or court proceedings in Maryland.
